Vietnam Issues New Circular on Conformity Assessment and Declaration of Conformity

The Ministry of Science and Technology (MST) of Vietnam has officially issued Circular No. 14/2026/TT-BKHCN, introducing updated regulations governing declarations of conformity with standards, declarations of conformity with technical regulations, and conformity assessment methods.

The new Circular came into effect on 25 May 2026 and replaces the previous Circular No. 28/2012/TT-BKHCN. The regulation introduces several significant changes aimed at modernizing Vietnam’s conformity assessment framework.

Key Highlights:

1. Risk-Based Conformity Assessment Framework
Products will now be classified into three risk categories—high, medium, and low risk—with different conformity assessment methods applied according to the assigned risk level. Detailed guidance on risk classification is expected to be issued by the authorities in due course.

2. Certificate Validity and Surveillance Requirements
Certificates issued under assessment methods 2, 3, 5, and 6 will have a maximum validity period of five years.

High-risk products: Surveillance required every 12 months.
Medium-risk products: First surveillance within 12 months, followed by surveillance every 24 months.
Low-risk products: Surveillance frequency to be determined through mutual agreement between the certification body and the certificate holder.

3. Introduction of E-Labeling
The Circular formally permits the use of electronic labeling (e-labeling), providing greater flexibility for manufacturers and suppliers.

4. Transition Provisions
Certificates issued prior to the implementation of the new Circular will remain valid until their respective expiration dates.

The introduction of Circular No. 14/2026/TT-BKHCN marks a significant step toward a more structured and risk-based conformity assessment regime in Vietnam.
