| Philippines Updates Operating Parameters for Short-Range Devices The National Telecommunications Commission (NTC) of the Philippines has issued Memorandum Circular No. 004-06-2026, dated 29 June 2026, amending Section 2 of Memorandum Circular No. 03-05-2007 to update the technical operating parameters for Short Range Devices (SRDs) used for movement detection and alert applications. The revised Circular updates the permitted operating frequency bands and maximum Equivalent Isotropically Radiated Power (EIRP) limits for this category of SRDs, which includes motion sensors, radar systems, and similar detection and alert technologies. Updated Frequency Bands and Power Limits Under the amended Section 2, the following operating parameters now apply: Frequency Band Maximum EIRP 2400–2483.5 MHz 25 mW 9200–9500 MHz 25 mW 9500–9975 MHz 25 mW 13.4–14.0 GHz 25 mW 24.05–24.25 GHz 100 mW 77–81 GHz 50 mW The most significant amendment is the introduction of the 77–81 GHz frequency band with a maximum transmission power of 50 mW EIRP. This spectrum is widely used internationally for automotive radar, advanced driver assistance systems (ADAS), and industrial sensing applications. Its inclusion provides manufacturers with a clear regulatory framework for deploying these technologies in the Philippine market. The Circular also specifies that the prescribed EIRP limits must not be exceeded under any operating mode or function of the equipment. Regulatory Background and Implementation The amendment was issued pursuant to the NTC’s authority under Act No. 3846 (Radio Control Law), Republic Act No. 7925 (Public Telecommunications Policy Act), and Executive Order No. 546 (1979). According to the Commission, the update reflects ongoing advances in wireless technologies while promoting the efficient and cost-effective use of the radio frequency spectrum. The Circular further provides that any previous circulars, memoranda, orders, or regulatory provisions inconsistent with the new requirements are deemed amended or superseded. The revised requirements will take effect 15 days after publication in a newspaper of general circulation and filing with the Office of the National Administrative Register (ONAR) of the University of the Philippines Law Center. Impact on Manufacturers Manufacturers, importers, and suppliers of movement-detection and alert devices—including automotive radar systems, industrial proximity sensors, and other short-range wireless equipment—should review their products against the updated technical requirements. In particular, products operating within the newly designated 77–81 GHz frequency band should be verified to ensure compliance with the 50 mW EIRP limit. Companies with products previously approved under the earlier version of the regulation should also assess whether the revised operating parameters affect their existing compliance status. |
