Decree No. 353: New Regulatory Processes in 2022

Government of the Russian Federation, in the middle of March (14 March 2022) published decree No.353 “On special provisions related to authorization procedures in the Russian Federation in 2022” dated by March 12, 2022.

According to annex No. 18 (peculiarities of product conformity assessment, validity of conformity documents and its extension as well as product and sample import), the Government of the Russian Federation decrees that the validity of conformity certificates and declarations (further – CoC and DoC) will be extended for a period of 12 months in case the expiry date of a CoC/DoC falls between March, 14th 2022 and September, 1st 2022. Additionally, manufacturers and importers have the right to refuse to provide documents on conformity assessment in case they import either spare parts for repairs or component parts for products and machines manufactured in Russia.

This regulatory legal act introduces the following changes are:

  1. The validity of license which expires from March 14, 2022 to December 31, 2022, is automatically extended for 12 months.
  2. It is not necessary to have a legal copy of CoC/DoC during a customs clearance (an authorization letter from a local representative to importer is still mandatory).
  3. Any spare parts intended for maintenance or repairing products imported to Russia earlier as well as components, raw materials or materials for final assembling in Russia DON’T REQUIRE any CoC/DoC.
  4. Until March 1, 2023, it is allowed to import goods intended for sale only within the territory of the Russian Federation without mandatory marking, including the EAEU mark. Nevertheless, labeling is still required to be able to sell the product to end-users.
