Licensing Structure for Application-to-Person (A2P) Services in Nigeria

The Nigerian Communications Commission (NCC), in accordance with the powers granted by the Nigerian Communications Act (NCA) of 2003, hereby informs all stakeholders that the Application-To-Person (A2P) Framework has been published on the Commission’s website and can be accessed at www.ncc.gov.ng.

A Stakeholders Forum regarding the Framework will be held virtually on December 20th, 2024.

The NCC is dedicated to ensuring full compliance with the provisions of the Nigerian Communications Act.

All interested stakeholders are encouraged to submit comments and contributions on the exposed A2P Framework by Thursday, December 19th, 2024. Please email all feedback to aadaba@ncc.gov.ng, with a copy to msyusuf@ncc.gov.ng.

NCC Sets Final Deadline for NIN-SIM Linkage Compliance: September 14, 2024

The Nigerian Communications Commission (NCC) has announced notable progress in linking Subscriber Identification Modules (SIMs) to National Identity Numbers (NINs) as part of the Federal Government’s 2020 policy. Over 153 million SIMs are now linked, achieving a 96% compliance rate, up from 69.7% in January 2024.

As the process moves into its final phase, the NCC aims for 100% compliance to bolster digital security, reduce fraud, and support financial inclusion. The NCC, in collaboration with the Office of the National Security Adviser (ONSA) and the National Identity Management Commission (NIMC), has identified cases of individuals holding excessive numbers of SIM cards and is addressing the issue of pre-registered SIMs.

All Mobile Network Operators (MNOs) are required to complete SIM-NIN linkage by September 14, 2024. Starting September 15, 2024, no SIM in Nigeria should be without a valid NIN. The public is encouraged to resolve any linkage issues before the deadline, using service providers or approved self-service portals.

The NCC also warns that buying or selling pre-registered SIMs is illegal and urges reporting such activities to the Commission. The NCC appreciates public cooperation in enhancing Nigeria’s digital ecosystem.

NCC Orders Telecoms to Ensure Transparency in Tariffs

The Nigerian Communications Commission (NCC) has directed telecommunications operators to simplify their tariff plans, bundles, and promotional offers. Issued on July 29, 2024, the directive titled “Guidance on the Simplification of Tariffs in the Nigerian Communications Sector” aims to make information about voice, SMS, and data services clearer and more accessible for subscribers.

Under the new guidelines, Mobile Network Operators (MNOs) are required to publish a detailed table of their tariff plans and bundles, including information on features, add-ons, prices, opt-in/opt-out procedures, renewal terms, and rollover policies. This measure follows consultations with industry stakeholders and data analysis on consumer needs.

The key goals are to reduce tariff complexity, ensure transparency and fairness in promotional offers, protect consumer interests, and foster fair competition by standardizing tariff structures.

Operators must also provide detailed information about their tariffs, such as plan names, prices, validity periods, call rates, data speeds, and fair usage policies. They can keep existing bonus-based plans until December 31, 2024, to transition subscribers to simplified plans.

Additionally, MNOs must present tariffs in a clear and user-friendly format, including full disclosure via Unstructured Supplementary Service Data (USSD). Stand-alone data bundles must be offered at fair prices, and promotional bonuses must be transparently stated. Operators are also required to meet Key Performance Indicators (KPIs) as per the Quality of Service (QoS) Regulations.

NCC Orders Swift Reactivation of Lines Affected by NIN-SIM Verification Problems

Over the weekend, many telecom subscribers faced disruptions as they were unable to access their phone lines due to issues with verifying their National Identification Numbers (NINs) against their Subscriber Identification Modules (SIMs). This led to their numbers being blocked by telecom service providers in compliance with the NIN-SIM linkage regulations.

The NIN-SIM linkage requirement, which began in December 2020, mandates that all SIM cards be linked to a verified NIN. Initially set for completion by April 15, 2024, the deadline was later extended to July 31, 2024, to provide additional time for consumers to complete the verification process. Despite these extensions, many lines remain unverified.

The Federal Government of Nigeria’s initiative aims to enhance national security and ensure an accurate national SIM ownership database. This policy is intended to protect user identities and support the growth of a secure digital economy.

In response to the recent disruptions, the Commission has instructed telecom operators to immediately reactivate all lines disconnected over the weekend, giving consumers a chance to finalize their NIN-SIM linkage. This reactivation is temporary, allowing users to complete the verification process.

The Commission urges all consumers who have not yet verified their SIMs to do so promptly to avoid further disruptions and ensure continued access to their phone lines

Auction of the 3.5 Gigahertz (3.5 GHz) spectrum

The Nigerian Communications Commission (NCC) has officially declared that the auction of the 3.5 Gigahertz (3.5 GHz) spectrum for the deployment of Fifth Generation (5G) technology in Nigeria, will take place on December 13, 2021.

According to the Information Memorandum (IM) presented by the Commission at a stakeholder engagement forum organized on 5G spectrum in Lagos recently, NCC is adopting Ascending Clock Auction format, which is software-based while a mock auction has been slated for December 10, 2021, as a precursor to the actual auction on December 13, 2021

Federal Government Approves 5G Deployment in Nigeria

The Federal Government has approved the deployment of 5G in Nigeria.

Following the approval, the Minister has directed the Nigerian Communications Commission (NCC) to commence immediate implementation of the 5G plan for the country. The roll-out of the 5G will be carried out in phases beginning with major cities in the country “where there is need for high quality broadband,” the Honorable Minister has said.

The NCC will publish an implementation roadmap for the deployment of 5G across the country with service roll-out obligations. In addition, the Commission has been directed to commence the development of relevant regulatory instruments to address issues related to health, safety and others to drive effective implementation of the roll-out of 5G by Mobile Network Operators (MNOs).

New procedure for type approval

 Nigerian Communication Commission (NCC) , updates in the Type Approval procedure concerning among others, sample requirements, family approval and billing method

1.Family applications: The NCC now accept applications for models that come in series and or families. In that case, the product should share the same test report.

2.Samples: One (1) sample should be provided for notebooks, tablets and mobile phones. For any other equipment type, a sample can be requested at any time. Samples won’t be returned by the Commission.

3.Processing time: If the complete documentation is received without errors, then on average it should take four (4) to eight (8) weeks for the applicant to receive a certificate / grant, assuming approval is granted and the invoice is paid.

4.Billing: The billing is subsidized as follows:

    • There is a group price for the whole family / series;
    • In addition to this group price, each device of the family / series is billed at 20% of the group price
