MTC authorizes regulations for the rollout of 5G and beyond in Peru.

The Ministry of Transport and Communications (MTC) in Peru has approved regulations for Legislative Decree No. 1627, aimed at promoting the deployment of 5G and higher public telecommunications services. This step is designed to enhance connectivity, digitalization, productivity, and reduce technological gaps in the country.

The regulations establish a framework for direct spectrum allocation, prioritizing companies that commit to significant investments. An auction process will be used to distribute the spectrum efficiently, with preference given to those making the largest investment commitments. The MTC highlights that this initiative will drive modernization, foster innovation, and support key sectors like mining, healthcare, and education, ultimately contributing to Peru’s economic growth and sustainable development.

The MTC has streamlined the process for automatically registering drones.

The Ministry of Transport and Communications (MTC), through the Directorate General of Civil Aeronautics (DGAC), has simplified the process for registering drones, making it quicker, easier, and fully virtual.

To operate a drone in Peru, it is mandatory to register it with the DGAC and obtain pilot authorization, with some exceptions under Law No. 30740.

It’s recommended to have all the drone’s technical data and the owner’s personal information on hand before starting the process.

Previously, this required submitting the “Appendix A” form with technical and personal data, which could take up to 30 business days to process. With the new system, registration is completed in minutes.

MTC made key regulatory advancements in 2024 to enhance digital connectivity.

In 2024, the Ministry of Transport and Communications (MTC) made significant regulatory advancements to strengthen digital connectivity in Peru, positioning it as a key driver for social and economic development. These measures included optimizing the Coverage Fee mechanism to improve rural access, regulating infrastructure sharing, and enhancing the radio spectrum for efficient telecommunications. The MTC also introduced environmental initiatives like removing unused overhead wiring and promoting sustainability in telecommunications projects.

Key progress was made with the introduction of 5G technologies, updates to the Telecommunications Law, and the establishment of Line 111 for public safety. Additionally, 24 agreements were signed with regional governments to improve technical capacities and connectivity, alongside international cooperation agreements with organizations in Korea, China, and the International Telecommunication Union (ITU) on issues like online child protection. These efforts underline the MTC’s commitment to technological modernization, digital inclusion, and regional development.

MTC Releases New Regulation to Accelerate 5G Adoption

The decree authorizes the Ministry of Transport and Communications (MTC) to directly allocate radio spectrum to interested companies following a call for expressions of interest, provided the demand does not exceed the available spectrum in the relevant frequency band.

Currently, 5G technology is being introduced in the country using the Non-Stand Alone (NSA) standard, which operates 5G stations over an existing 4G LTE network, similar to early implementations in other countries.

The decree aims to allocate sufficient spectrum in line with international standards to support the Stand Alone (SA) standard, enhancing speed and capacity up to tenfold.

“5G will facilitate widespread device connectivity without sacrificing transmission quality, supporting applications like the Internet of Things, telemedicine, tele-education, automation, and remote management,” emphasized Minister Pérez Reyes.

The decree also mandates that companies receiving spectrum allocations commit to investing in expanding 4G coverage in rural and socially prioritized areas. They will need to extend 4G service along key routes, including the Panamericana Norte, Sur, and major national roads, and provide necessary infrastructure for the Pan American Games.

The new regulation is designed to enhance telecommunications services, enabling 5G networks to accommodate more users, connections, and higher speeds.
