ENACOM revised the regulation

ENACOM – Regulatory Authority of Argentina, revised the requirements for low power devices operating in the frequency range
915 – 928 MHz, 2,400 – 2,483.5 MHz and 5,725 – 5,850 MHz.
According to the resolution 551/2021 those device must comply with the specifications set out in ENACOM-Q2-60.14 V20.1
„Low Power Devices“.
In case of renewals the test report used for the initial approval may still be applied during the renewal process as long as compliance with the new limits is still given.

EQUIPMENT AUTHORISATION REGULATIONS 2021

The South African “Independent Communications Authority of South Africa’s” ICASA released on 31 March 2021 their new draft regulations on “Equipment Authorization Regulations”. New is the conformity assessment approach based on 3 classification levels for low, medium and high risk equipment, where low risk equipment is exempted from equipment authorization.

Furthermore, a 2-step authorization process is implemented, where first a certificate of conformity with limited validity must be obtained before a homologation certificate “Equipment Authorization” can be issued by the authority.

There is also an adjustment to the label requirements, where a minimum height of 3 mm is specified for the ICASA logo. Also the equipment class must be referenced. There are no provisions for exemptions.

New Unmanned Aircraft System (UAS) Rules

Govt. of India notifies new rules for Drones called Unmanned Aircraft System Rules, 2021 effective 12th March 2021

Highlights of UAS Rules 2021

 

  • UAS have been categorized as airplane, rotorcraft and hybrid with further categorization as remotely piloted aircraft, model remotely piloted aircraft and autonomous unmanned aircraft system.
  • UAS have been classified as Nano, Micro, Small, Medium and Large unmanned aircraft based on the maximum all up weight including its pay load ranging from less than 250gram to 150 kilograms. Nano UAs can be classified in the next higher category if it exceeds performance parameters of flight speed and height.
  • It is mandatory for individuals and companies to obtain approval from the DGCA to Import, Manufacture, Trade, Own or Operate drones.
  • No Permission- No Take-off (NPNT) policy has been adopted for all UAS except for those in the nano category.
  • Micro and small UAS are not permitted from flying above 60m and 120m, respectively.
  • All UAS, except nano category, have to be equipped with flashing anti-collision strobe lights, flight data logging capability, secondary surveillance radar transponder, real-time tracking system and 360 degree collision avoidance system, among others.
  • All UAS including nano category, are required to be equipped with Global Navigation Satellite System, Autonomous Flight Termination System or Return to Home option, geo-fencing capability and flight controller, among others.
  • UAS prohibited from flying in strategic and sensitive location, including near airports, defense airports, border areas, military installations/facilities and areas earmarked as strategic locations/vital installations by the Ministry of Home Affairs.
  • Nano, micro and small UAS operations limited to within the visual line of sight and are prohibited from delivery of goods.
  • Research and development (R&D) organizations, including start-ups, authorized UAS manufacturer, any accredited recognized institution of higher education located in India, are permitted to carry out R&D of UAS only after obtaining authorization from the DGCA.
  • Penalties ranging between rupees Ten thousand and One lakh for individuals, and for organizations, it can be 200% to 400% of the amount specified for individuals, based on the size of the organization.

New Type Approval Regulation for R&TT Equipment

Telecommunications Regulatory Commission of Sri Lanka (TRCSL) updated the Type approval procedure of Radio and Telecommunications Terminal Equipment (R&TTE) in December 2020. Thus, the issued certificates will be valid only for 6 months. It is necessary to reapply for approval procedure to get access to the market of Sri Lanka within this period.  

Please, note that if the product has already been Type Approved by the TRCSL, you can apply under simplified procedure. It means that there is no need to provide test reports. However, a representative sample would be required.

The main changes in the Regulations concern the following:  

  1. Type Approval fees;
  2. Quantity of samples: the TRCSL can request up to 2 samples and keep them for 2 years;
  3. Mandatory labeling requirements for all equipment approved by TRC. However, the label requirements become mandatory from June 16, 2021. Please, note that the label must be permanently affixed on the packaging of R&TTE and it can be obtained only from the TRCSL with an additional fee;
  4. The importation of certain types of R&TTE (to be determined by the Commission from time to time) may be exempted from Type Approval. In this case, you need to get an exempt letter;
  5. Submitted test reports must be issued no later than within 3 months from the submission day by an accredited test lab. However, if test reports older than 3 months the documents require a declaration of validity from a test lab;
  6. The validity of the certificate and the exempt letter were extended up to 4 years;
  7. The certificate holder can be only a local company that has the telecommunication license.

Brazil Amends Technical Requirements for Conformity Assessment of Radio Communication Equipment

National Telecommunications Agency of Brazil (ANATEL) issued Act No 1306 on February 26, 2021. This Act amends Act No. 14.448 on Technical Requirements for the Conformity Assessment of Restricted Radio Communication Equipment with regard to broadband wireless access systems.


It establishes requirements to the systems operating in the 5.925-7.125 MHz frequency bands. Thus, Indoor Access Point and Subordinate Access Point must meet the following rules:

  • The average value of EIRP power is limited to a maximum of 30 dBm
  • The average value of the EIRP power spectral density is limited to a maximum of 5 dBm / MHz
  • The equipment must be used only in indoor environment

A Client equipment operating under the control of an indoor Access Point  must meet the following rules:

  • The average value of EIRP power is limited to a maximum of 24 dBm
  • The average value of the EIRP power spectral density is limited to a maximum of -1 dBm / MHz
  • The equipment must be used only in indoor environment

Extremely Low Power Equipment must meet the following rules:

  • The average value of EIRP power is limited to a maximum of 17 dBm
  • The average value of the EIRP power spectral density is limited to a maximum of -5 dBm / MHz

Please, note ер that the Indoor and Subordinate Access Points must be powered directly by the electric power network. Battery power is not allowed. The Indoor and Subordinate Access Points, Client Equipment, and Very Low Power should use only embedded antennas

Malaysia Updates MCMC /SIRIM Certificate Format

SIRIM QAS International Sdn. Bhd of Malaysia has changed the content of the certificate. The new form of certificate starts to be issued from the middle of February.  These changes were made according to the Malaysian Communications and Multimedia Commission requirements on including specific information on the product. So now if there is any module in the approved product, information on the module will be indicated in the certificate as well

Merge DWLF & M and TRA. Previously there have been 2 communication regulators operating in Bahrain. The ‘Directorate of Wireless Licensing, Frequency & Monitoring’ (DWLF&M), and the ‘Telecommunications Regulatory Authority’(TRA), will be merging and type approvals for all products will be issued by TRA moving forward.  Although the merger has not yet been officially announced

New Type Approval Regulations

Pakistan PTA proposed new Draft Regulation of Type Approval Technical Standards. The proposed entry into force date was proposed to take effect on January 25, 2021.

The main changes in this proposal are the inclusion of the acceptance of IEC 62368 safety test reports to support Type Approval applications.

Also, in Annex E, the list of terminal equipment exempted from type approval have been changed. Specifically, the following has been deleted in this draft which would remove the exemption on these products and bring these products into scope of the requirements:

  • * Tablet PC with Wifi only Functionality (Non – Sim based devices)
  • * Smart Watches with Bluetooth / Wi-fi Functionality only (Without SIM or Tracking)

If these regulations are approved, this would mean these products would be subject to type approval in Pakistan.
