EMC Certification Body accredited by AZAK

According to Resolution No 175 of the Cabinet of Ministers of the Republic of Azerbaijan dated August 21, 1998, all types of telecommunications equipment and devices (both as a complete set and as a communication module) imported to the territory of the Republic, sold for sale and operation, must be certified in accordance with the requirements of the interconnected telecommunications network. It is the manufacturer’s duty to ensure that the technical level and quality indicators of products, as well as electromagnetic compatibility, meet the standards throughout the country.

In accordance with the amendment No. 608-VQD dated April 14, 2017 made to the Law of the Republic of Azerbaijan ,certificates of conformity are issued by accredited bodies. Since there was no EMC compliance assessment body before December 2020, EMC standards were also reflected in AZS certificates by AZS certification bodies. However, on 02 December 2020, a certification body was empowered by the Azerbaijan Accreditation center (AZAK) to conduct certification for compliance with EMC standards and reflect the relevant EMC standards in these certificates

Brazil Issues Amended Telecommunications Products Reference List

The ANATEL issued the Act #7280 dated by November 26, 2020. The document was officially released on December 3, 2020. The Act contains the amended Telecommunications Products Reference List as well as new rules for renewal procedure.

The Telecommunications Products Reference List determines the types of products that require to pass the conformity assessment procedure in the form of certification or declaration as well as the schemes of conformity assessment procedure and the time of periodic assessment.

In general, the amendments concern the time of periodic assessment and type of certification schemes.

Thus, the time of periodic assessment was extended from one year to two years and from two years to three years. Types 1a and 4 of certification schemes were excluded from the available conformity assessment models and only type 5 of certification scheme is remained. It means that certification of products is based on type testing with periodic evaluation of the product and the evaluation of the factory management system.

The Act becomes effective in 180 days from its official publication and replace the Act # 2222 dated by April 20, 2020.

Conformity Marking in Northern Ireland

Conformity Marking in Northern Ireland

Starting from January 1, 2021 the UK is not a part of the EU anymore. However, the leaving of the GB from the EU faced some issues. One of such issues was the border between Northern Ireland and the Republic of Ireland as the latter remains a member of the EU. Neither the government of the GB nor the government of the Republic of Ireland want to create a visible border between the Republic of Ireland and Northern Ireland.

That is why the UK and the EU have agreed on a new invisible “regulatory” border between Northern Ireland and Great Britain (England, Scotland and Wales) and signed the so-called Northern Ireland Protocol.

According to the Protocol, Northern Ireland follows the relevant EU rules on placing goods to the market that are proved by the presence of the EU conformity mark on such goods. So, EU conformity marks remain applicable in Northern Ireland to show that the product meets EU legislation. In most cases, we talk about CE marking.

However, if you use a UK notify body for third-party conformity assessment you need to put a special conformity mark starting from January 1, 2021. This mark consists of four letters: UKNI (sometimes referred to as the UK(NI) mark or the UK(NI) indication). The UKNI mark must always be applied together with the CE mark.

When you put the product to the EU market, you must use the CE marking on its own, without the UKNI marking. This means that goods that are intended for being sold on the EU market cannot be assessed against EU rules by a body based in the UK.

Thus, when the product is going to be put on the market of Northern Ireland, the applicable mark depends on the involved assessment body:

If the product was assessed by using an EU notified body, the CE mark should be used on the product and it is enough to put the product on the NI market;

If the product was assessed by using an UK notified body, the UK(NI) mark must be used together with the CE mark to put the product on the NI market.

Russia Clarifies GLN/GTIN Issue Within Conformity Assessment Procedure

Approval of the procedure for declaration of conformity registration and the procedure of the register keeping in Russia. The procedure is regulated by the Order of the Ministry of Economic Development and Trade of the Russian Federation # 478 and became effective from January 1, 2021.

According to the Order, when the place of goods production is out of the EAEU, the applicant should indicate Global Location Number (GLN) as well as Global Trade Item Number (GTIN) in the application form on the declaration of conformity registration. The GLN allows to identify the manufacturing place, while the GTIN allows to identify the product itself.

However, as it was discovered later, not every production unit has the GTIN and applicants also faced the problem with the GLN. For this reason, the Ministry of Economic Development and Trade of the Russian Federation made some changes with regards to the GLN and the GTIN. The Ministry issued the new Order # 877 dated by December 30, 2020. The document provides a transition period with regards to the GLN indication. It also made correction to the Order #478 with regards to the GTIN. According to the amendments, the information on the GTIN is not mandatory for the indication in the application form.

Currently, the Order # 877 is on the approval. Once it is approved, the above-mentioned amendments become effective. In terms of certification, the following requirements will become mandatory from August 1, 2021, according to the Decree of the Government of the Russian Federation from November 18, 2020 No. 1856 “On the procedure for the formation and maintenance of a unified register of certificates of conformity, the provision of information contained in the specified register and payment for the provision of such information”.
